Welcome to www.plinc.com (the 'Site'/'Plinc'), a social sharing site designed specifically for you and your wish-lists. These Terms of Service ('ToS'), together with any referred to terms and/or policies, content, functionality and services ofered will apply to anyone who accesses and/or interacts with the Site for whatever reason.

By accessing and using the Site, you agree to these ToS. If you disagree with any part of the ToS then you may not access or interact with the Site for any purpose.

1. What we do

We have created Plinc as a social sharing site. To enjoy the full experience of this Site, you'll need to create an account by providing us with certain information, including Personal Data, like your name and email address (refer to our Privacy Policy to see what we do with this information). You should provide us with information that is accurate, complete, and current at all times. Failure to maintain your information is a breach of these terms and your account may be suspended or even deleted.

As part of our services, we want to show you things that we think you might love. We can only do this by identifying you and your interests. We'll try to make sure that anything promoted on our Site is relevant to you and that any promoted content is clearly identifiable as such.

2. Your information and password

To create an account, you will supply us with certain information. At Plinc, your Personal Data is specifically used as follows:

  • We store your email address and password for authentication and login purposes;
  • We use your real name for your account, but this is not displayed publicly;
  • Age verification is required but this information is not stored;
  • Your location (country) and language preferences will be stored;

You must keep your password safe and not share it with anyone else. You are entirely responsible for safeguarding the password that you use to access our Site and for any activities or actions under your password, whether your password is with our Site or a third-party service. Any losses you may sufer as a result of any use of your password, with or without your consent, will be solely yours to bear.

Let us know immediately if you become aware of any breach of security or unauthorised use of your account.

3. Using Plinc

3.1 Your Information

Plinc is a worldwide social sharing platform. Due to the nature of the internet, this means that any information you submit in creating your account may result in the transfer of information across international boundaries. Your information, including Personal Data, may be transferred to – and maintained on – servers that are located outside of your country of residence. We won’t transfer your Personal Data to any organisation or country that doesn’t have the same privacy ethos and standards as it would if it was processed within the EEA, as applicable. 3.3 No under 13’s

Our Site is not intended for anyone under the age of 13. If you live within the European Economic Area (‘EEA’) you must only access our Site if you are old enough to consent to the processing of your information under the laws of your country unless your parents/guardians are willing to consent on your behalf. When you create an account on our Site, you are confirming that your are old enough and legally capable of creating binding obligations, including any loss or liability you may incur through using this Site.

3.4 The content on and information within our Site

You can electronically store any content available on our Site for your own personal, non-commercial use only but any other use, reproduction, modification, distribution, republication, retransmission, storage or incorporation of any part of the Site in any other work, is prohibited without the prior written consent of Plinc.

When you create an account on our Site, we will grant you a limited, non-exclusive, non-transferrable, revocable right to use and access the Site for its intended purpose only. You won’t acquire any further rights or interest in the Site. This means that Plinc will retain all right, title and interest in and to the Intellectual Property Rights to and in any material or content of the Site, including, but not be limited to, copyright, trademarks, patents, as well as Site developments, customisations, enhancements and future releases. If you want to use the information or content on our Site, for any reason other than the intended purpose, you need to get our permission first.

You are prohibited from exploiting our Site commercially; you may not licence, lease, rent, assign, transfer, sell or subject the Site to any form of commercial exploitation. You’re also prohibited from reverse engineering, decompiling, decoding, decrypting, disassembling, or in any way deriving source code from the Site.

3.5 Your content

On Plinc, you will be able to post and save content and images, as well as post comments and links. You keep the rights to, and are solely responsible for, anything you post or make available for public view on our Site.

You agree to grant to Plinc and other users of the Site a royalty-free, sublicensable non-exclusive, transferable worldwide license to use, display, save, modify, create, and store your content on Plinc. You also agree to grant to Plinc the right to use your content, including but not limited to concepts, ideas, inventions and techniques without any restriction on us or compensation to you. These rights shall apply even if your account is deactivated or terminated, for whatever reason, which means that Plinc and its users can continue to use your content that other users have shared and stored on their own accounts even if you deactivate your account.

Through the Plinc platform, we are creating a sociable community where users can engage with each another in a fun and friendly environment. We take the community spirit very seriously so, like with any social community, there are ‘rules of engagement’ and ‘codes of conduct’ (‘Code’) that you should observe and will be expected to abide by. Any user who fails to observe these may have their account suspended and, for more serious offences, even terminated.

The following are examples of serious offences:

Hate Speech - Any derogatory or insulting comment/s directed at a specific group of people will not be tolerated. Any comment deemed to be derogatory or insulting to people based on discrimination including but not limited to race, age, sexuality, physical characteristics, gender identity, disability, religion and/or nationality will be considered hate speech.

  • Harassment - Bullying and harassment will not be tolerated on this Site. This may include:
    • Using any form of media or quotes to mock another user.
    • Creating multiple accounts to bully and harass other users and trying to evade a ban.
  • Calling a user a derogatory name, or derivative thereof, referring to physical features.
  • Repeatedly submitting false reports or reporting false violations against another user shall be deemed unacceptable.
  • Prompting a user/s to 'kill yourself' shall be deemed unacceptable.
  • Repeated unwelcome sexual comments shall be deemed to be harassment and unacceptable behaviour on our Site.
  • Threats – Threats, whether meant as a joke or not, are never acceptable. A threat may take many forms, including threats of harassment, threats of doxing, swatting. Impersonation – Impersonating someone else or trying to create the impression that the account is that of another is not acceptable. Instances of impersonation will be reviewed and decided on a case by case basis.
  • Suspension Evasion - Any attempts to create a new account and/or identity after being suspended from the Site will not be tolerated and will result in a permanent ban by such user.
  • Offences, or suspected offences, can be reported directly to us and we will investigate and make a decision. We will do our best to take down any offensive material as soon as possible. Please don’t abuse the reporting system.

4. Indemnity

Be mindful of what you post. You are responsible for your use of and interactions on our Site, including your account and content, and you agree to indemnify, and keep indemnified, Plinc against any loss, liability or cost which Plinc may incur as a result of your use of and interaction with the Site other than in accordance with these Terms, unless the loss, liability or cost comes about due to our negligence or breach of these Terms.

5. Disclaimers

Our Site, including our service and content, is provided 'AS IS', therefore, all material accessed or downloaded from the Site is obtained and used at your own risk. It is your responsibility to use appropriate virus/protective software. We make no warranty, express or implied, that the Site will operate uninterrupted or error-free. The information on our Site is provided for general information and should not be relied upon or used as the sole basis for making decisions without consulting primary sources. Every efort has been made on our part to keep the information on our Site up-to-date and accurate but we’re not responsible if that happens not to be the case.

Any reliance on the material and information on this Site is at your own risk and we will not be liable for any personal, financial or other losses or hardships that arise as a result of consulting the information on this Site.

6. Liabilities, Warranties and Representations

Plinc will not be liable for any direct, indirect or consequential loss or damage (including, without limitation, loss of profits, business, anticipated savings, goodwill, use of data) caused by the use and/or reliance on, or the inability to use, the Site which results, without limitation, from inaccurate information, omissions, interruptions, suspension, errors, defects, viruses, delays in operation or transmission, or any other failure of performance with respect to the Site (unless otherwise provided for by law).

All conditions, warranties and representations, expressed or implied by (i) statute, (ii) common law or (iii) otherwise, including, without limitation, conditions, warranties or representations of fitness for a particular purpose or satisfactory quality, are excluded to the fullest extent permissible by law.

Plinc’s liability for damages under or in connection with these Terms, howsoever arising (including but not limited to, material breach of contract, negligence or tort or the use or inclusion of any document, material, idea, data or other information), shall be limited to £50.00.

This does not affect any warranties that cannot be excluded or limited by English law, or any other law, as applicable.

7. Third party links, sites and applications

Our Site may contain links to third party applications, advertisers, events and activities that are not owned or controlled by Plinc. These third-party links have been provided for convenience and information purposes only and shall not be deemed an endorsement by us of the content thereof. We cannot accept liability or responsibility for any statements, information, products, services or policies that are accessed or provided to you through any of these external third-party links – you will be accessing these third parties at your own risk.

These terms of service and our Privacy Policy only relate to our Site. We urge you to read the privacy statements and Terms of Use of any third-party links you access through our Site.

8. General terms

8.1 Changes

We may make changes and/or effect upgrades to the Site from time to time (which may include, without limitation, to its operation, appearance or information made available). We may also make changes to these Terms or our policies.

We will notify you either clearly on the home page of the Site or by email that changes/upgrades will be made to any of the Terms or our policies and when they become efective. You agree to receive any legal notices electronically, if that’s what we decide.

If you don’t like or don’t agree with any of the changes, please stop using the Site.

8.2 Dispute resolution

If you have a dispute with Plinc, including our Site or our services, you agree to contact us first so that we can try and resolve the dispute informally. If we are unable to find an informal resolution, you agree to proceed to arbitration. Arbitration is a less formal way of resolving matters than a lawsuit.

Any dispute arising shall be referred to and finally resolved by arbitration under the Rules of the London Court of International Arbitration, as appropriate, which rules are deemed to be incorporated by reference. The number of arbitrators shall be one. The seat, or legal place of the arbitration shall be London, England. The language to be used in the arbitrary proceedings shall be English. Arbitration does not stop either you or Plinc from obtaining interim relief (including injunctive relief) from any court of competent jurisdiction.

8.3 Termination

Plinc may terminate or suspend your account and/or your right to access our Site for any reason. We will give you appropriate notice, if appropriate, unless you are in violation of our ‘rules of engagement and ‘code of conduct’ in which case we may terminate your account without notice. If your account is terminated, for whatever reason, you are still bound by sections 3 and 4 of these ToS.

8.4 No waiver and severability

Our failure to enforce any of the rights or provisions afforded to us under these Terms will not be considered a waiver of those rights. If any of the provisions of these Terms is held to be invalid or unenforceable by a court, the remaining provisions will remain in efect.

8.4 Jurisdiction and applicable law

These ToS and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) or relating to our Site or services shall be governed by and construed in accordance with the laws of England. The English courts will have non-exclusive jurisdiction over any dispute or claim insofar as such is not in contravention of any applicable law/s.

8.5 Rights of third parties

Unless expressly stated in these ToS, nothing in these Terms of Service will confer any rights on any person under the Contracts (Rights of Third Parties) Act 1999.

8.6 Assignment

Plinc may, at any time and from time to time, assign, novate or transfer any rights or licenses granted under these terms, without restriction. You do not have the right to assign, novate or transfer any rights or licenses granted under these terms. We will give you reasonable notice of any assignment.

You are entitled to deactivate your account at any time if you do not agree with this provision.

8.7 Entire agreement

These Terms, including our Privacy Policy, any amendment, updates and additional agreements constitute the entire agreement between you and Plinc concerning this Site and our services. These Terms supersede any previous agreement relating to the use of the Site.
